The short version

  • Your farm’s records belong to you. We only use them to run HerdHand for you and your team.
  • HerdHand records information. It doesn’t give veterinary advice, so check calculations such as withholding dates.
  • Changes made offline are only on your phone until they sync. Export important records regularly.
  • It’s free during early access and features may change. We’ll tell you before we charge for anything.
  • Your rights under Australian Consumer Law always apply.

1. About these terms

These terms are an agreement between you and [Legal entity name] (ABN [ABN]) (“HerdHand”, “we”, “us”). They cover your use of the HerdHand mobile app, the services behind it and this website (together, the “Service”).

By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you use HerdHand for a farm business, you confirm you’re authorised to accept these terms for that business.

2. Your account

  • You must be at least 18, or using HerdHand under the supervision of a parent, guardian or employer who accepts these terms.
  • Give accurate details and keep your password private. You’re responsible for what happens under your account.
  • Tell us straight away at hello@herdhand.example if you think someone else has accessed your account.

3. Farms, owners and teams

The person who creates a farm in HerdHand is its owner. Owners and managers decide who can access the farm and what role each person has. Anyone you invite can see the farm’s records, according to their role.

If you add other people’s personal information, such as staff, buyers or your vet, make sure you’re allowed to. Where needed, tell them it will be stored in HerdHand.

If people disagree about who controls a farm, we’ll generally follow the farm’s owner as recorded in HerdHand. We may ask for evidence before making changes.

4. Your records belong to you

You, or the farm you record for, own the records, photos and documents you put into HerdHand (“your content”). You give us permission to store, copy, display and process your content only as needed to provide the Service to you and the people you share it with, including backups and the exports you ask for.

You’re responsible for your content and for having the right to upload it. An owner can export a farm’s records at any time.

5. HerdHand records information. It doesn’t give advice

HerdHand is a record-keeping tool. It doesn’t diagnose animals or recommend treatments, doses or management decisions, and nothing in the Service is veterinary, financial or legal advice. Get advice from a veterinarian or other qualified professional.

Calculations in the app, such as due dates, gestation countdowns, withholding end dates and report figures, are worked out from the information you enter, such as dates and product label details. Check them before you rely on them. You remain responsible for meeting your legal obligations, including withholding periods and export slaughter intervals, animal welfare, biosecurity, and livestock identification and traceability (such as NLIS).

The farm assistant uses AI to answer questions and fill in records from what you tell it. AI can misread a request or get details wrong, so check its answers and any record it creates before you rely on them.

6. Offline use, syncing and backups

The app stores records on your phone so you can use it without reception, and syncs them when you’re back online. Changes that haven’t synced are only on that phone. If the phone is lost, damaged or signed out before syncing, those changes may be lost. When two people change the same detail, the app keeps one value and asks you to review the other. We back up our servers, but you should keep your own copy of important records, for example by exporting them regularly.

7. Using HerdHand fairly

You agree not to:

  • break the law, or use the Service to mislead others, for example with false animal histories or health records in a sale;
  • upload anything you don’t have the right to share, or anything harmful such as malware;
  • try to access another farm’s records, or any part of the Service you haven’t been given access to;
  • interfere with the Service, overload it, or get around its security or usage limits; or
  • copy, resell or reverse engineer the Service, except where the law allows it.

8. Early access, changes and availability

HerdHand is in early access. Features may change, be added or be removed as we improve it. We aim to keep the Service available and your data safe, but we can’t promise it will always be available, uninterrupted or free of errors. Some features, such as signing in, invitations and PDF exports, need an internet connection.

We’ll give reasonable notice before we make a change that significantly affects how you use HerdHand.

9. Fees

HerdHand is currently free. If we introduce paid plans, we’ll tell you the price and terms beforehand. You won’t be charged unless you choose a paid plan.

10. Our intellectual property

We own the HerdHand app, website, name, logo and software, or have licences to them. We give you a personal, non-exclusive, non-transferable licence to use the app for as long as you have an account and follow these terms. If you send us feedback or ideas, we may use them without owing you anything.

11. Australian Consumer Law and our liability

Our services come with guarantees under the Australian Consumer Law that can’t be excluded. Nothing in these terms limits those rights or any other rights the law says can’t be excluded.

Where the law lets us limit our liability for a failure to meet a consumer guarantee, our liability is limited, at our choice, to supplying the services again or paying the cost of having them supplied again.

To the extent the law allows:

  • we aren’t liable for indirect or consequential loss, or for loss of profits, revenue, stock value or data that you could reasonably have avoided, for example by syncing or exporting your records; and
  • our total liability to you under or in connection with these terms is limited to the greater of the fees you paid us in the 12 months before the claim and AUD $100.

These limits don’t apply to the extent loss is caused by our fraud or wilful misconduct.

12. Ending your use

You can stop using HerdHand at any time. To have your account or a farm you own deleted, email hello@herdhand.example. Before you go, export anything you want to keep.

We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires us to. Unless the law or a risk of harm prevents it, we’ll tell you first and give you a chance to export your records. If we ever shut down the Service, we’ll give at least 30 days’ notice so you can export your data.

13. App stores and other services

You download the app from the Apple App Store or Google Play, and their terms also apply. If you sign in with Google or Apple, their terms apply to that sign-in.

If you use the iOS app, you and we agree that: these terms are between you and us, not Apple; Apple has no obligation to provide maintenance or support for the app; Apple isn’t responsible for any product claims, intellectual property claims or warranties relating to the app; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. Governing law and disputes

These terms are governed by the laws of [State], Australia, and you and we submit to the courts of that state and the federal courts of Australia. If you have a problem, please email hello@herdhand.example first. We’ll try to resolve it with you directly.

15. Changes to these terms

We may update these terms. We’ll post the new version here with a new date, and for significant changes we’ll tell you in the app or by email at least 14 days before they take effect. If you keep using HerdHand after that, the new terms apply. If you don’t agree, you can stop using it and ask us to delete your account.
